July 13, 2026: Public Hearing: Hentges Rezoning - PL2026-038

On February 3, 2026, the Scott County Board of Commissioners approved the rezoning of the 79 acres property from A-1, Agricultural Preservation District, to TR-C, Transition Reserve Cluster District, and Preliminary Plat and Final Plat of Sutton West consisting of 4 lots and 1 outlot on 79 acres. The rezoning from A-1 to TR-C changed the development density from 1 dwelling unit per 40 acres to 1 dwelling unit per 10 acres, which allowed clustering of 4 single family residential lots east of South Sutton Lake Boulevard. Rezoning to TR-C required preservation of 80% of the non-wetland land on an outlot to qualify for the cluster development.
Following approval of the Sutton West plat and rezoning, it was discovered that Joseph and Gloria Hentges, the applicants and property owners, have a lease agreement with a cellular communications company to erect a monopole cell tower on the property. This agreement prevented filing of the plat because the TR-C zoning district does not allow wireless communications towers. After review with county staff, it was determined that a solution would be to split the outlot into Outlot A and Outlot B and rezone Outlot B to A-3, Agricultural Preservation Density District, which does allow wireless communications towers as a Conditional Use.
