July 13, 2026, Public Hearing: John & Emily Neisen Variance #PL2026-037

John and Emily Neisen are requesting a variance to expand their legal non-conforming single-family residence beyond the 50% expansion allowed by County Ordinance. Legal non-conforming structures are classified as such when they do not meet an ordinance regulation such as a required setback. By Ordinance a legal non-conforming structure is allowed to expand by up to 50% of its existing square footage provided such expansion does not further decrease the distance between the structure and the applicable property line. 180th Street West functions as a private roadway for this home and two adjacent homes on the road.
The Neisen home is a two-level rambler that was built in 1962 having a 800 square foot basement, 1,551 square foot main level and 934 square foot garage., which is a total of 3,285 square feet existing. The structure is located 21 feet from the southern property line, with the required setback from the property line being 30-feet. The applicants are proposing to add a second story to the home that would total 2,088 square feet, which would be a 63.56% increase.
