Matthew and Gabrielle Hager are requesting a variance to reduce the required side setback from 30 feet to 16.4 feet for an addition on their existing accessory building. The 2,400 square foot accessory building was built in 2001 by a previous owner of the property. After a fire damaged the structure in 2024, the applicant’s rebuilt the structure at 4,860 square feet which is larger than the size of the existing structure without obtaining a building permit. The addition extends the accessory building 20 feet closer to the side property line. A after-the-fact building permit application was not made until February 2025.
The 10-acre property is partly open and partly wooded. There is a wetland in the center of the parcel, that the surrounding land slopes towards. The south end of the property varies in elevation by over 25 feet, generally sloping towards the east. The property immediately adjacent to the encroachment is a 63-acre parcel in agricultural production.
