Development Services Department
The Development Services Department requests an amendment to Provo City Code to add the Mixed Use Zones as Chapter 14.14D and Signs Permitted in Mixed Use Zones as Section 14.38.106 and amend related development standards. The amendments to the development standards are for Section 14.34.500 relating to fencing standards for residential zones, Section 14.37.100 relating to parking design standards, Section 14.34.287 relating to residential design standards, and Section 15.20.080 relating to supplemental landscaping requirements by zone.
Chapter 14.14D would include two zones, the Mixed-Use (MU) Zone and the Neighborhood Mixed-Use (NMU) Zone. The two mixed-use zones correlate together and City staff saw a need to include the two zones in one zoning chapter, which is common and best practice. Provo City currently has the Downtown zones (DT1, DT2, GW, WG, and ITOD) and Campus Mixed Use (CMU) zones that permit a mix of uses. After a critical analysis of these zones, staff does not believe that these zones would fit outside of their respective areas. Two relevant policies from the General Plan to consider are to (1) determine the appropriate mix and intensity of residential and commercial uses; and (2) be cognizant of transition from neighborhood centers into established neighborhoods (1.2.8). Additionally, the Franklin Neighborhood plan says that no land use zone works to establish a neighborhood center and that a land use zone needs to be established (pg. 16 and 18). Each of the neighborhood plans (Downtown, Maeser, Franklin, Southeast, and Joaquin) discuss mixed-use development and has goals and/or policies for such. Lastly, the Southwest Future Land Use Map identifies areas to allow mixed-use development. This application is to further the goals and objectives of the General Plan, all neighborhood plans, and the Southwest Future Land Use Map. Staff has identified that the addition of the Mixed Use Zones and supporting code revisions would further development within Provo City where the neighborhood plans identify mixed-use development.

This item does not require a neighborhood meeting since it is a citywide application. The application has been under review by various Provo City departments and was discussed by as at the April 13 Planning Commission study session. It is scheduled to be heard at the May 25 Planning Commission hearing. Because it is an ordinance text amendment, it will also need to be heard by the Provo City Council (currently scheduled for June 7, 2022).
