The Amendment language (10. Deviations to Approved Single-Family Residential Subdivisions) is overly vague, and allows neighbors to gang-up on other neighbors, for the purpose of limiting that owner's development rights. All lots on record paid for the road to be paved, and sewerage to be installed on Bradley Circle (for example). This is an off-plantation area - not a organized neighborhood. There is not even a POA/HOA - so they are attempting to get around this with this Amendment. Each parcel owner has a right to build (for a home or a rental); and no other owner should have the right to limit other's rights to build within the law - because of a perceived 'ruining of our neighborhood'. Bradley Circle (again for example) was always a vacation neighborhood (and some mixed residential); well before the Marriott built an enormous time-share complex directly adjacent. The proximity to the beach makes it great for both purposes. Several lots are yet to be developed, and existing owners knew this prior to purchasing to live here full-time, part-time or otherwise. Marriott was previously given a R/W, in order to bring Bradley Circle an alternate entrance. In my opinion, this access-road issue should be re-visited. This would allow Sandy Trail to be closed to car traffic, and eliminate the primary concern of residents. I have forwarded a email message to both Town and County Planners about this. Beyond this, it is not nearly as congested as many other beach-front neighborhoods. Any effort to limit the rights of existing owners in this neighborhood are punitive - and are directed at one or more specific owners with whom a select group of other owners disagree with about everything. I should go on the record to say that these targeted amendments came about after failed attempt by Town to purchase property on Bradley Circle for open space. In fact, the frontage lots were offered to other residents before being sold to the current owner. Rather than leveraging the LMO to gain increased restrictions on land owners (which are vague); I argue that Bradley Circle residents should create an HOA, not burden the Town with every perceived slight - nor create increasing obstacles to building that will affect every island landowner.
